Update
I know you haven't heard from me in awhile but we have been preparing for trial which was suppose to start November 5, 2007, one day before our second anniversary. As the ones know who have been through this stage justice never prevails for our murdered children. The DA's office offered my sons killer a plea for 2nd degree murder with aggravating ciscumstances with a sentence of 25-30 years. Now this is for a man who confessed to shooting my son 15 times while he was running for his life, they have a confession, the murder weapon and a witness to testify against him but they settled for a plea instead of trying to convict on 1st degree with a life sentence. The problem is the killer has maintained that my son reached for something and he got scared and started shooting. Forensics prove my son did not reach for anything and had defense wounds. This is also the SOB that said he was shooting with his eyes closed while my son was running away at night and hit him 15 out of 17 shots. Our county according to the DA's office is a self defense county and all they have to do is the defense has to put in their mind it could have been and they could have let him walk free. So to make sure we were guaranteed some time in prison they offered the plea and he took it three weeks later. We as a family thought maybe we would have some peace with getting it over with and not having to endure a trial where my son would be made to look like he asked to be murdered but I can tell you we are having a harder time dealing with it than I thought. Please pray for us that we can get through this. Sentencing should be this Thursday. I was told by the DA's office not to discuss this but I know you all understand better than anyone. Jane |

Hi Jane: The DA is just too lazy and uncaring to do his job because no matter how much the defense attorney tries to make it look like self-defense anyone running away no longer poses a threat so there was no reason to shoot your son 15 time. Given the fact that you have a confession, murder weapon, witness and a lousy self-defense claim, the case for 1st degree should be opened and shut. Don't stress too much over the number of years he gets because there is nothing the judicial system can do that will bring Matthew back to you in this life but God is watching and his judgement is better than anything the lousy system can give. Amen Tracey! Dear Jane, I am just disgusted to hear this. I can only hope that the coward gets sentenced to the maximum number of years and is well hated in prison. We too are preparing for refiling the charges (after 6+ years) and it is daunting. I don't know how I would process a deal like you got. I would imagine it would be very hard as well, especially as it doesn't make any sense! I don't believe that Matt's killer should EVER see the light of day. But, as Tracey says, mans justice will pale in comparison to Gods, and His will be eternal! I just hope this coward idiot is sent to meet his maker before his pitiful sentence in over! I feel your pain. Plea agreements are put to the victims family as if to do us a favor. Life seems like a good sentence however the murdering *** has his first parole hearing just 14 years into serving a prison stay. It's so devastating that the justice systems values our children lives at just 14 years. True they may not be paroled but we must relive again having to fight for justice to keep our children's murders locked up. |

Jane, how awful! I agree with all the MOMS comments thus far. The judicial system is not in our loved ones favor at all. It is a politically and financially run institution and makes no sense to have the word justice involved. JUSTICE for who??? For our corrupt system? I am so sorry you have to go through this. My family has received nothing but lip service in my sons murder so I guess you at least got something. I know it will not bring your Matt back, but agree with the other MOMs that Gods justice will serve us so much better. My prayers go out to you and yours. Kay |
