Preliminary Hearing
The monster who took my precious Myles' life will have his preliminary hearing on Monday, November 13th. It will be held in Juvenille court since Myles was only 21 months old and then will be moved to Circuit court if it is indeed goes to trial. I keep hoping that someone will kill him prison, then I will never have to hear about him or lay eyes on him again. It makes me so upset and anxious to know that I will have to set eyes on this monster and can't kill him like he killed my child. I don't know what to expect, anyone who has been to one, any thoughts you have would be appreciated. http://myles-simon.memory-of.com/ |

I was confused by this too but that was the explanation that was given was because Myles was a juvenille. The worthless sack of human skin who killed him was 24. |

YOU WILL NOT GET AN ARGUMENT FROM ANYONE HERE THAT THE DEFENSE AND PROSECUTORS ARE ALL SLEEZZZZ BAGS AND YOU'VE GOT TO REALLY MAKE IT ALL YOUR BUSINESS TO FIND OUT WHAT'S GOING ON. I live in the state of VA. The long and short is that my children (3 year old daughter and 21 month old son) were dropped off at their babysitter's house one morning. At some time after 9am the babysit came to leave the house and run an errand, only to return around 11 to my son being unresponsive. She called the paramedics but her husband fled before they and the police arrived. The paramedics came and adminstered CPR and other meds, but my baby was flatlined. From the start it was handled as a homicide as standard procedure but the police must have suspected foul play from the jump as this man ran before they got there. Later after an autopsy it was determined that my son died of blunt force trauma basically after having been beaten to death. An open and shut case IMO since the only adult in the house was my babysitter's husband and 3 children including my son. Plus my daughter was able to tell the police that her brother got a "spanking". Actually, an attorney that I work with says that in many states these cases start off in Juvenille court if the victim is a minor especially so if child abuse is a factor in their death. |

I AM SO VERY SORRY THAT THIS HAPPENED. AND WHAT AN ANIMAL TO PREY ON SUCH AN INNOCENT VICTIM. THANK GOD YOU DAUGHTER WAS NOT KILLED TOO. WHAT ELSE WOULD HE HAVE HAD TO LOOSE. I AM JUST SO SURPRISED AT THE LAW THERE. I AM IMAGINING THAT THIS DOES NOT MEAN HE WILL BE JUDGED UNDER JUVENILE, BUT THAT THE JUVENILE COURT WILL PASS IT ALONG TO A HIGHER COURT. AND IT'S SUCH A SAD THING IN THIS WORLD WHERE A MOTHER FINDS TRUST IN SOMEONE ENOUGH TO LEAVE HER CHILDREN FEELING SAFE, SO THAT SHE CAN HELP MAKE THEM A LIVING AND SUCH A HORRIFIC PERSON CAN BE WAITING IN THE SHADOWS. Dear Michelle~ I am with everyone else here. I understand what you are saying, but it seems illogical. The criminal charges should be based on the age of the perp, not the victim--children's lives are no less valuable than adults. Plus, you're always hearing on the news that juveniles are "tried as adults" due to the severity of the crime-usually homicide. I hope that in preliminary they will view this then bump it to adult criminal court...I mean, what would they do, put this 24 year old in with a bunch of 14 year olds? Like I said, it doesn't make much sense. That being said, court is a very tangled web. The defense will most likely say that the guy was not guilty, they will probably try and say that the injuries were already there then made worse by said "spanking" because usually the best defense is a good offense. And offensive it is...since they can't blame baby Myles, they will try and blame you. With my family they attempted to build their case in pre-trial around everyone being culpable for their own murders. I.E. my dad must've been rude to the perp, it was probably self defense, yada yada yada~ The truth of it is that the guy broke into my parents home, ambushed them, shot them point blank, hid their bodies, waited for the kids, ambushed them, shot my son to disable him then went on to over kill both he and his girlfriend, Josie. Clearly they didn't invite this~ but a defense attorney will put the most appalling spin on things...I hope that this doesn't happen to you, but few of us here have nothing nice to say about defense attorneys for a reason. Steel yourself, you will need all of your faith and composure. They will usually say things that your mind hasn't ever entertained because they are so ridiculous. Remember that the truth will rise, and don't bat an eye. Like survivior, "outwit", "outlast", "outplay". I know it is not a game, but that is how it will be treated and it is sickening. The upshot is, you are there to represent Myles, your presence will be a thorn in their sides, take notes, write down questions. Trust your prosecutor as far as you can throw him/her. Be a proactive part of this (our taxes pay their salaries!) and let them know you are a team. I know that I may be sounding harsh, but court is a complete revictimization, as if things aren't bad enough...we will be here for you. And if we need to call/write the governor or whomever to get this into adult criminal court, we will. This guy should never have touched your child with anything other than love. Hi Michelle: The two of us have so much in common, I too am for New York, Brooklyn to be exact and I now live in Richmond Virginia. So I know how it is to leave a place known for its murder and crime rate only to have your child murdered in Virginia. Sadly, the biggest difference is that my son was 22 YEARS old while your precious baby was only 21 MONTHS old. I have never heard of anything so ridculous as basing the jurisdiction of the crime on the age of the victim. God truly works in mysterious ways because I am a paralegal however I deal with corporate law, not criminal however, they just hired a former prosecutor to work at my job and I will be sure to ask him if trying Myles case in juvenile court is standard procedure in Virginia. I wanted to take this time to say how much I admire you that you are strong enough to go back to work so soon after losing little Myles. I will pray for your little girl Sydney that she will only have precious memories of her baby brother and that any visions of Myles "spanking" will be wiped from her memory. Girl, if you are strong enough to go back to work, then you are strong enough to look that coward SOB in the face at the trial. We MOMS are a force to be reckoned with and while we might not physically be in the courtroom, we will all be there in spirit. Please let me know if there is anything I can do. Thank you ladies for the information. Tracey, I have been able to go back to work and function because I am surrounded by a wonderful family, great co-workers and you Moms on this board who can commiserate with me. But most of all I have God and he has my baby and I won't let the devil destroy my life and my surviving child's life. The devil is busy and is looking for more families and lives to destroy. I talked to the victim specialist today and she basically told me the same as you ladies that the defense is going to try to get this monster a bond and try to come up with all manners that Myles could have received a fractured skull....like falling off a chair or I hurt him then dropped him off at the sitter's house. The only good information I received from her is that the county I live in--Fairfax County--is known for being tough on murder cases. And the fact that the coward ran indicates that he knew he did something to my baby that resulted in his death. Regardless, me, my husband, my immediate family and in-laws will all be there in court to make sure Myles not just another faceless, nameless statistic. Thanks again ladies |

MOMS, Tommorrow is the preliminary hearing for the monster that killed Baby Myles, please pray for Michelle and her family that they will stand strong when they face the demon that took their precious son, brother, grandchild, nephew and cousin from them and most importantly that this monster gets the justice he deserves. The hearing was just horrible. I thought I was prepared and I really wasn't. They first told me that they believe Myles was violently beaten (they think they know how but I don't want to give to many details to hurt the case) by Mohammed Ahmad but are still waiting all of the autopsy reports and tests. The Juvenille Court Room is extremely small (the prosecutor had forwarned me of that). But I littlerally sat 2 feet from the demon whole took my child's life. He had no expression on his face, no remorse, no nothing. He kept his eyes straight ahead and even his family (only two of them) would not look me and my husband in the eye. His wife was the only witness and she described how I dropped my kids off that morning and Myles appeared to be fine, and how she left to run an errand leaving her husband to watch the kids, only to return to find Myles in a play pen with his eyes rolled back in his head. I lost it then and screamed and ran out of the courtroom. Even that knowledge that my child was lying in a playpen possibly hurt for over an hour the sitter said she was gone for 2 hours) just pained me so. I had already been told that Myles had several blunt force blows to the head and stomach, so I just couldn't get the image of my child lying helpeless and in pain in a play pen while that monster sat on the couch with his laptop. Yes, his wife said when she returned her husband was sitting on the couch on a laptop not seeming to have a care in the world. His snake of a lawyer was trying to draw attention to everything thing and every one else since the time of the injuries was not brought up in court as if I hurt my child and dropped him off at the sitter. The judge did bind the case over for trial which was the whole point, but basically the only witness is his wife and she DOES NOT have to testify, although we believe she will and my husband and family members who sat through the entire hearing said she was very believeable and remorseful. The other tough part is that to prove 1st degree murder you have to prove that the monster planned and intended to kill Myles. Also, manslaughter charges only carry up to 10 years. I am trying to stay positive but the thought of this monster being out on the streets after 10 years is just too upsetting for words. The one thing is that he is that the demon is not a US citizen but a legal alien, so the US Court System could easily deport him back to India or Pakistan (not sure which one he is from) after he has finished serving his time. |

And Lorre you were so right, the defense attorney is already trying to make it anyone else's fault that Myles had blunt force trauma to his head and abdomen. There was even a question of where the entrance to the house was--as if someone entered the house, killed my son and then left without the demon noticing. PUHLEASE. The problem the snake attorney will have defending the demon is that he ran to New York and the fact that even his wife says that he questioned whether they should call 911 cause "she might get in trouble since she didn't have a license" (to operate a daycare). |

Dear Michelle, I am glad to hear that the judge did bind the case over. Clearly there was enough evidence that the perp is culpable of murdering your sweet baby Myles. I expect that the autopsy findings will define the charges from manslaughter to aggravated homicide. I'm sure that there will be enough evidence of trauma there, as much as it sickens me to say that. I don't think premeditation has to be a long thought process, just the knowledge that the results of the action will or might be death. I am sorry about court. You're right, it is exactly what I was talking about before. It is SO emotionally wrenching. The things they speak of so casually...It hurts you to your very soul. Please believe that your sweet baby was in angels arms before he felt any pain. I believe that God delivers us from death in that sense as well as He can see the outcome of events. Michelle, I look at Myles and I just want to kiss his precious face. He radiates every good that God intended. But that evil Mohammed Ahmed, he is another story. What he did to Myles notwithstanding, his name alone is not going to fly well in prison. I do not believe that he would survive even a 10 year sentence. I am glad that you let us know what happened. This court system is nothing less than pitiful. Defense attorneys have a special place reserved in Hell I'm sure, most of them I've encountered anyway. The one in your case seems equally as inhumane. ((((((((MICHELLE))))))) I wanted to let you know that I am thinking about you,,and though the circumstances and ages of our children are different, having a child taken from you by homicide is a nighmare that will not go away. The criminal justice system RETRAUMATIZES families over and over, even if the police do a great job, when it gets to the courts, the death of our children is nothing but a sick game, defense v.s. prosecution. I sent the first DA that was handling my sons case a slideshow of him,,after she presented it to the grand jury as second degree murder, even though the investigator charged him with first degree. A week or so later, I got a call from the DA's office, that another DA was handling the case, and he represented it to the grand jury and GOT the first degree indictment. People that have never lost a child to murder, wonder how we get through each day. IT IS THE LOVE FOR OUR CHILDREN THAT KEEPS US FIGHTING.
